The Legal Foundation: Power of Attorney
Every management relationship in this practice is formalised through a registered Power of Attorney executed in your favour.
What the management PoA covers:
- Tenant-finding and execution of Leave and License Agreements on your behalf
- Rent collection and financial management
- Routine maintenance authorisation up to a defined monetary limit

What the management PoA explicitly does NOT cover:
- Sale or transfer of the property

This limitation of scope is intentional and protects you. A properly drafted management PoA gives the manager exactly the authority needed to manage — nothing more.
Executing the PoA from abroad:
If you are already outside India, the PoA can be executed at the Indian Consulate or Embassy in your country of residence, or before a local Notary Public followed by Apostille certification (for countries signatory to the Hague Convention). The document is then sent to India for registration at the Sub-Registrar’s office in Pune.

Legal Compliance for NRI Property Owners
Owning property in India as an NRI creates specific legal obligations that go beyond what a resident Indian property owner faces. These are not optional — non-compliance has real consequences.
FEMA Compliance
The Foreign Exchange Management Act governs how rental income from Indian property flows to your foreign account. Rental income must be credited to your NRO account first. Remittance abroad from the NRO account is subject to annual limits and documentation requirements under the RBI’s Liberalised Remittance Scheme provisions for NRIs.

TDS on Rental Income
Under Section 194I of the Income Tax Act, a tenant paying annual rent exceeding ₹2.4 lakhs to an NRI landlord is required to deduct TDS. The rate differs from the rate applicable to resident landlords and is significantly higher.

Tenant Stops Paying Rent
The registered Leave and License Agreement is the foundation of the legal remedy. Under the Maharashtra Rent Control Act and the terms of a properly executed L&L Agreement, a licensee who fails to pay licence fees is in breach. Step 2 — Document review
You share the title documents, existing tenancy agreements if any, and society details. We review and identify any matters needing attention before management begins.
Step 3 — PoA drafting and execution
We draft the management PoA. If you are in India, it is executed and registered here. If you are abroad, we guide you through the consulate or apostille process.
Step 4 — Property inspection and handover

Frequently Asked Questions
1. What is the difference between a lawyer-managed property and a broker-managed property?
A broker has moral accountability — they want your future business and referrals. An Advocate managing your property under a registered PoA has legal accountability. The scope of authority is defined in a registered document. If the manager acts outside that scope, you have a legal remedy. More practically: when a tenant dispute arises and legal action is required, the same person managing your property is also the lawyer handling the legal escalation — with no gap, no referral, no delay.
2. Does the Power of Attorney allow you to sell my property?
No. The management PoA used in this practice explicitly excludes the power to sell, transfer, mortgage, or create any charge on the property. The scope is limited to management activities. If you subsequently want to sell the property and require a separate sale PoA, that is a separate document executed for a specific purpose — and that too only at your explicit written instruction.
3. I am in the US / UK / UAE. How do I execute the PoA from abroad?
You can execute the PoA at the Indian Consulate or Embassy in your country. Alternatively, you can sign before a local Notary Public and have the document Apostilled (for countries under the Hague Convention). The apostilled document is sent to India and registered at the Sub-Registrar’s office in Pune. We guide you through every step of this process.
4. My property is currently rented with an informal agreement — no registration. What happens?
This is a common situation. An unregistered Leave and License Agreement significantly weakens your legal position if the tenant disputes anything or refuses to vacate. The first step is assessing the current situation — tenant relationship, rent amounts, how long they have been there — and then transitioning to a properly registered agreement. We handle this transition carefully to avoid disrupting a functioning tenancy unnecessarily while establishing the proper legal foundation.
5. Can you manage a vacant property — one that is not currently rented?
Yes. Vacant property management is a distinct service because the risks are different. A vacant flat in Pune still needs monthly physical inspection, society dues management, property tax compliance, utility monitoring, and documentation. Encroachment — including fraudulent documentation — is a real risk for long-vacant NRI properties. We provide specific protocols for vacant properties.
6. How does rent reach my account in the US / UK / Australia?
Rental income is credited to your NRO account in India. From the NRO account, remittance abroad is governed by FEMA regulations and RBI guidelines. There are annual limits and documentation requirements. We coordinate with your CA to ensure remittances are FEMA compliant and properly documented. We do not handle CA or tax services directly — but we work alongside your CA as part of an integrated process.
7. My tenant is deducting TDS from the rent before paying me. Is that correct?
If your annual rent exceeds ₹2.4 lakhs and you are an NRI, the tenant is legally required to deduct TDS under Section 194I of the Income Tax Act. The rate for NRI landlords is different from and higher than the rate for resident landlords. The tenant must deposit this TDS and issue you a Form 16A. This is not the tenant taking money from you — it is a statutory deduction that you credit against your tax liability when filing your Indian income tax return. We clarify this with tenants at the time of agreement execution so there are no misunderstandings.
8. What if I am not satisfied with the management and want to terminate the arrangement?
The management PoA is revocable. The process for termination, transition of documents, final accounting, and PoA revocation is straightforward and documented. You are not locked into a perpetual arrangement — the PoA can be revoked by you at any time with written notice. We facilitate a clean handover.
9. I have multiple properties in Pune. Can you manage all of them?

10. I inherited property from my parents in Pune and I live abroad. Where do I start?
Inherited property often needs attention in a specific sequence: confirm that mutation has been completed in your name at the relevant office (PMC, PCMC, or Talathi), ensure the society share certificate has been transferred, obtain a fresh Encumbrance Certificate to confirm no encumbrances were created by the previous owner, and review the title documents. 11. My relative has been informally managing my property for years. Can I transition to professional management without causing a family problem?
This is a delicate situation and one we handle carefully. The transition can be framed as a professional administration step — not a reflection on the relative’s trustworthiness. The relative can continue to be a point of contact for emergency situations locally while the formal management, documentation, and financial accountability rests with this office. The specific approach depends on your situation and is discussed at the initial consultation.
12. Do you handle property management for resident Indians, or only NRIs?
Both. NRIs are the primary audience for this service because the problems of distance and accountability are most acute for them.
